Who Will Shape Cupertino's Future Growth: Residents or Developers and Big Business?

The November General Election will decide whether Cupertino will grow and change according to the needs and interest of residents (Measure C for Citizens) OR urbanize according to the financial interests of developers, their global investors, and big business (Measure D for Developer).

All viable campaigns need funding. The developer behind the Vallco office park project has spent millions to support Measure D for Developer and to discredit Measure C for Citizens and all who back Measure C for Citizens.

On September 12, the developer dropped another $1,000,000 into the PAC that supports its campaign goals. I expect we will see more big cash drops like this one before Election Day.

If we are serious about ensuring that residents have a voice in the future development of Cupertino, we must raise funds to support that commitment. Talk with family, neighbors, and friends about making substantial contributions of $250 or more to our essential campaigns.

I encourage all to think about what you value about your life in the West Valley and how it will change based on whether or not Measure C for Citizens passes in November.

Fight Against Bullying by Developer-Employed former Council Members
     - Don't Let Sand Hill Censor Our Ballots! Again.

Dear Cupertino Area Residents,

On August 25, 2016, two former Cupertino Council Members, employed by the developer to promote Vallco office park Initiative, filed a lawsuit to try to censor voters' arguments about Measure C from the November ballot. Measure C is formerly Cupertino Citizens' Sensible Growth (CCSG) Initiative, submitted by citizens to encourage sensible growth for the citizens of Cupertino and to give citizens a voice in the future direction of growth in Cupertino.
  • One plaintiff is a paid consultant of Vallco’s developer, Sand Hill Property Co. (SHP), and the other is the paid Public Affairs Manager for Vallco.
  • Besides these two individuals, other former Cupertino Council Members have also been actively lobbying and promoting the massive office park at Vallco in a competing Measure D, sponsored by Developer SHP.

The CCSG Initiative (now Measure C) gives the decision power for the future direction of growth back to the Cupertino voters. Unlike citizens in other cities overflowing with massive developments, Cupertino voters have a chance this November to make a choice:
Sensible Growth versus Growth determined by City Council and special interests.

We need to protect our right to make such a choice without interference from developers and their lobbyists. The City Council already adopted a misleading and deceptive ballot question for CCSG Initiative following requests of SHP’s attorneys. Now the developer-employed former Council Members are suing the grassroots citizens to silence them again. Enough is enough!

Let’s stand up together with the supporters of CCSG Initiative.
Their actions represent people power, at the core of American culture. When facing strong opposition, we don’t give up and we fight back.

Do You Want to Live in a Crowded and Noisy Urban City?

Dear Community,
   We take some things in life for granted, but will they disappear before we notice it?
   What we appreciate about Cupertino that sets it apart from more crowded cities might disappear as more and more high density developments creep into our beloved city.

   As suburban Cupertino gets transformed into an urban city, our night won't be quiet any more since our streets will be filled with traffic well into the night, like most streets in an urban city. Our streets won't be safe for our kids to ride bikes to schools anymore since the streets will be filled with impatient drivers who have been stuck behind the wheels for an extended period of time. We will become one of the impatient and stressed drivers as our daily commute become longer and longer.
   Our daily lives don't have to become more crowded and more stressful. Our beloved city does not have to transform into a crowded urban city. Unfortunately, the City Council and developers in town have made decisions for us. They have decided to turn Cupertino into an urban city and the massive office development at Vallco leads the way. 

   Fortunately, we still have a chance to stop it. A group of concerned residents at BetterCupertino are working hard to inform other residents about upcoming changes. We don't have to accept a more crowded and stressful life. Together we should be in control of our beloved Cupertino. We live here. We decide.

   Unfortunately, the developers are sending their paid out-of-town canvassers to go door to door to provide deceiving information to Cupertino residents. Our City Council is doing nothing to dispute the misinformation spread by the canvassers for developers. BetterCupertino needs your help.

   The City Council allocated massive office space to Vallco in 2014 without sufficient public hearing, even when the Council was already aware that Apple Campus 2 would worsen traffic congestion and housing crisis. 
   We are standing against the City Council who granted 3 times more office and removed 160 senior housing units to Main Street project without sufficient justification.

Two generous anonymous donors have stepped up to match any donation of over $150 for up to $4,000 within a 48-hour period to help reach the target of $50,000 Legal Fund. The clock will start running from Monday June 20 at 6pm to Wednesday June 22 at 6pm. The recommended donation per household is $200. The price of two family meals to help compel the City Council to comply with Election Code to provide the voters "true and impartial" ballot question, "not likely to prejudice" voters.

Without a fair vote for CCSG Initiative in November election, Cupertino will be put back on the path of hypergrowth, where three votes of the City Council can approve ultra-high density projects like Sand Hill's massive office park at Vallco. Even if the voters refuse the Vallco Initiative at the ballot, the City Council can still approve a slightly reduced version, despite of strong opposition.




>> Writ of Mandate Filed to Remove Deceptive Ballot Language Inserted under the influence of developers and their lobbyists.

The CCSG Initiative gives the voters a choice between hypergrowth, favored by the City Council with heavy influence by developers, and sensible growth, where new projects follow a long-term plan. But, the CCSG Initiative is in grave danger because the City Council, under pressure by developers (by a bare 3-2 margin), adopted deceptive language for the November ballot question, based on false interpretation of the initiative and Cupertino's General Plan. CCSG Initiative maintains existing building heights in all areas, including Neighborhoods (30 feet). But the ballot question falsely states that CCSG Initiative will increase building heights in the Neighborhoods to 45 feet, as requested by attorneys representing Sand Hill. Keep in mind that most voters will only read the ballot question, and will use it to decide whether to vote for or against the CCSG Initiative. That’s how critical the ballot question is.

On Monday June 13th the CCSG Initiative Committee filed a Writ of Mandate at the Santa Clara County courthouse to order the City to correct its ballot label. The lawsuit is expected to cost about $50,000. The CCSG Initiative has put in $15,000 and we need your help for the remaining fund. This is the time for grassroots citizens to band together and pitch in to protect our city and to assert justice for the citizens. Lack of action or involvement today will result in higher living expenses with worsen quality of life under unplanned developer-driven hypergrowth.
Cupertino Voters Deserve a True and Impartial Ballot Question of CCSG Initiative in order to exercise their rights of democracy.


>> Oaks Initiative Will Aim for Special Election, to be Paid by Taxpayers.

KT Urban, the developer behind the Initiative to redevelop Oaks Shopping Center into high density mixed use project, has announced that the Oaks Initiative won't be put in November election. KT Urban will continue to collect signatures to aim for a special election costing about $500,000-$1,000,000, to be paid by the taxpayers. Every signature to "just put it on the ballot" is a signature to agree to fund an election for the developer's project while skipping a developer-paid environmental impact review.

The Master Plan is a long-term plan (till year 2040) to implement policies adopted in Dec. 2014. BetterCupertino recommends the following:
  • Request ground-level parkland for large development, preferably onsite of the development project.
  • Request that the priority be put in purchasing more parkland in areas with insufficient parks or access to parks, instead of allowing developers to pay for parkland mitigation.
  • Request that the existing parkland is preserved in size and not get reduced for other purposes like parking.
  • No rooftop park should be counted towards parkland requirement.
  • Large development projects should provide parkland instead of parkland mitigation fee.
  • Parkland mitigation fees from development projects should be applied to the area impacted most by the projects.
  • Consider 1.5% annual population growth per year when all projects follow the General Plan. Cupertino will face almost 40% increase in population in 25 years. What's needed in the park master plan to cope with that population growth? If massive development projects like Vallco and Oaks get approved, how could the park master plan cope with the accelerat

>> Projects to be Approved: Marina Plaza and Hamptons

  • Marina Plaza at the northwest corner of De Anza and Stevens Creek - June 28 at Planning Commission. July 5 at City Council Meeting. Replace 44,000 square feet of retail space by 23,000 square feet of retail space, 122 room hotel,188 residential units, including 16 below market rate units. 45 feet tall.
  • Hamptons Project at the northeast corner of Wolfe and 280 - May 10 at Planning Commission. June 6 at City Council Meeting. Replace 342 apartments by 942 apartments at 75 feet tall. ZERO affordable housing.

>> Projects Under Construction: Hyatt House Hotel, Main Street, Apple Campus 2.
  • Hyatt House (KCR) HotelAlready approved. 148 room, 5 story hotel. A full service 2,500 square-foot restaurant, 2,160 square-foot meeting room, and 320 square-foot boardroom.
  • Main Street: Under construction. 120-unit market rate apartment. ZERO affordable housing. 180 room hotel. 295,000 square feet of office space (but only 260,000 allocated). 1.55 acre town square and park.
  • Apple Campus 2: Under construction. 175 acre area. 2.8 million square feet of office space. A 1,000 seat auditorium, research facility of 600,000 square feet, fitness center and central plant.

Sand Hill's Vallco office park Initiative collected 3,679 signature, but only 79.1% or 2,912 were valid signatures. Only 11.7% of the 24,753 registered voters. On Monday June 6, the City Council has the option to adopt the Vallco office park Initiative even without waiting for 9212 Report.

In comparison, CCSG Initiative collected 4,204 signatures and 89.4% or 3,759 signatures were valid. The volunteer team of circulators for CCSG Initiative collected almost 30% more valid signatures than Vallco Initiative. 

The Vallco Initiative only collected 473 signatures more than the 10% required. If you have signed the Vallco Initiative because you were misled by the circulators, it is important that you report your encounters to California Secretary of State: http://www.bettercupertino.org/#!report-violation/lj9m4.


>> Sand Hill's flyers says "We Could Be Surrounded by 4-story Houses." Total Fabrication!

15-year old Charlie "could" drink alcohol today, but the likelihood of him drinking any alcohol is zilch since he is not legally allowed to drink and Charlie knows to follow the law.

Your neighbor "could" build a 4-story house today (regardless of whether CCSG Initiative is adopted), but it is unlikely since it is not allowed under the zoning code and the City Council most likely would ask your neighbor to follow the law. The adoption of CCSG Initiative doesn't make it any more likely to build 4-story house.

The building height, setbacks and other design parameters are limited by the Zoning Code in various zones, including residential neighborhoods. No one can build 4-story houses today since the Zoning Code only allows 2-story buildings for residential neighborhoods. Therefore, Sand Hill's claim is a fabrication.

Sand Hill's flyers never told the truth about the Hills at Vallco. Sand Hill's flyers now fabricate lies about CCSG Initiative. It is up to the educated voters of Cupertino to see through the smear campaign and see the truth.
Why does the City Council and developers fight so hard against CCSG Initiative? Is it because CCSG Initiative would protect Cupertino from exploitation of profit-driven developers and the Councilmembers who are heavily influenced by them?

Sand Hill actively manipulated the City Council to railroad CCSG Initiative with the deceptive ballot question meant to prejudice the voters. CCSG Inititave Maintains Existing Building Heights, incl. Neighborhoods (30 feet). There is no ambiguity. 

The transformation of the Ballot Question from Law-biding to Prejudicial - Maneuvers of Developer through the City Council - is a manifestation of the alarming problem in Cupertino and the troublesome problem of representative democracy. Sand Hill's Vallco office park Initiative has submitted 3,700 signatures for verification. However, how many of the voters who signed the Vallco petition knows that most community benefits are not locked in as a requirement in Sand Hill's Vallco Initiative.
Below is just a partial list of commonly mentioned benefits that are NOT locked in by the Vallco Initiative, as RevitalizeVallco.com might imply. Sand Hill won't be required to provide any of these benefits.
  • "will spearhead": free shuttles.
  • "may include": pedestrian trails, a playground, vineyards, orchards, organic gardens, an amphitheater, pavilion buildings, community hub, student union and a nature area. A refuge for native species of plants and birds.
  • "may include": a general purpose community hub, an approximately 1,000 seat banquet hall, and a 300-seat outdoor amphitheater.

>> CCSGI Does Not Support Any Developer-Sponsored Initiative Because...
  • By signing any developer-sponsored initiative, you agree and encourage developers to take a shortcut to project approval through the initiative process. The developers get to skip environmental review process, public comment and hearing and Planning Commission and City Council approval.
  • By signing any developer-sponsored initiative, you agree for the taxpayers to pay for a superficial 9212 report for a development project so that the developers can skip a comprehensive multi-faceted environmental impact study under CEQA.
  • By signing any developer-sponsored initiative, you agree to allow developers to wow voters with fancy marketing materials with promises while hiding project details that requests special treatment or exceptions in hundreds of pages of legalese.
  • If any one project gets speedy approval through the initiative process, more developers will follow the success story. Cupertino voters won't be fooled.
NOTE: The North De Anza Gateway Initiative for the Goodyear Tire site, near 280 and De Anza, is not compatible with CCSGI. The project applicant should follow the normal project approval process.

>> City Council Did Not Give CCSGI a Fair Chance on April 5 and Still Won't One Month Later.
Despite numerous emails to request to put the ballot question of CCSGI on May 3rd agenda, Cupertino City Council did nothing. Mayor Barry Chang met with a few people from BetterCupertino on Sunday, but he was not willing to listen to reason and insists to blindly trust EC 9212 Report without rational explanation. Other Councilmembers did not respond at all to either requests for a meeting nor request to discuss the matter during May 3 Council meeting.

The Council would rather to stick to a deceptive ballot question, which even City Attorney does not feel comfortable with, since it doesn't conform to Elections Code 9051. The City Council refuses to comply with Elections Code 9051 to adopt a true and impartial ballot question so that it does not prejudice voters against CCSGI.

The effort to recall Barry Chang is driven mainly by a group of individuals who were long-time Barry supporters. Some campaigned tirelessly for Barry Chang in 2014 and some have been Barry's friends since Barry started his political career.   This group of former supporters of Barry Chang felt betrayed by Barry because of his unprofessional behavior and anti-resident actions dating back to just after the 2014 election.The events leading up to the April 5 meeting to forcefully adopt the deceptive ballot question of CCSGI to completely align with the request of Sand Hill's attorney was simply the last straw that broke the camel's back. The CCSGI committee and BetterCupertino are not fully involved with the effort of Recall Barry Chang group, except a few members who are involved as individuals.
Nevertheless, the CCSGI committee and BetterCupertino do support the goals of the Recall Barry Chang group and will help the recall effort, as needed.

Amend the Ballot Question of CCSG Initiative to Comply with Elections Code




Here is the address to email City Council: CityCouncil@cupertino.org.

Please request the Council to amend the ballot question for CCSG Initiative to comply with Elections Code to be a "true and impartial statement of purpose" and not "likely to prejudice" voters against the CCSG Initiative. Until 4 pm today, April 29, 2016, the City can still amend the regular May 3rd City Council meeting agenda to add an item to amend the ballot question for the CCSG Initiative and remove the deceptive language. After 4 pm today and until 4 pm on Monday, May 2, 2016, the City can amend the ballot question for the CCSG Initiative if the City Council chooses to call a 9 pm City Council meeting to immediately follow the regular City Council meeting on May 3rd.
It would be an expensive embarrassment for Cupertino if the City Council must be compelled to comply with the Elections Code through a lawsuit, especially when their March 31 and April 5 decisions regarding the ballot question language contradict the text of the CCSG Initiative and the content of the General Plan amendment that this sitting City Council approved in  October 2015 (Resolution 15-087). Unless the City Council acts now to repeal the deceptive language they introduced into the ballot question during the March 31 and April 5 City Council meetings, the Taxpayers will pay to undo the City Council's poor decisions in the courtroom. Both City Attorney Mr. Hom (on April 5) and the City's outside counsel Mr. Perlmutter (on March 31) recommended against putting "increase building heights" in the ballot question of CCSG Initiative because introducing prejudicial language about building heights would likely not be considered compliant with Elections Code 9051.
